Terms of Service

1. Acceptance and eligibility

These Terms govern your use of AI PhotoPrompt at aiphotoprompt.io, including prompt discovery, account features, credit purchases and AI image generation. By creating an account, purchasing credits or using paid generation, you agree to these Terms and the Privacy Policy.

You must be at least 18 years old and legally able to enter into this agreement.

2. The service

AI PhotoPrompt is a digital AI service for discovering prompts and creating or editing images with third-party AI models. Features, model availability, generation speed and output quality may change as upstream providers evolve.

3. Accounts and security

You may sign in with Google or a verified email one-time code. First sign-in may automatically create an account. Keep access to your email/Google account secure and notify us promptly of suspected unauthorized access.

• Do not create or coordinate multiple accounts to repeatedly claim promotional credits.
• Do not sell, transfer or share account access in a way that bypasses product controls.
• You are responsible for activity performed through your authenticated account.

4. Credits and one-time top-ups

AI PhotoPrompt currently uses a one-time credit top-up model. We do not currently offer an automatically renewing subscription or automatic credit recharge.

• Paid credits are usage units for AI PhotoPrompt services, are not cash, are non-transferable and cannot be redeemed for cash.
• Paid credits do not expire while your account remains active, unless a future offer clearly states otherwise before purchase.
• Promotional or free credits may have an expiration date shown when granted.
• Generation pricing is displayed in credits before submission. The server-side pricing rule in effect when the job is created controls the final charge.

5. Billing and payment

Each top-up is a one-time transaction. By completing checkout, you authorize the amount displayed at checkout to be charged. Payments are processed by Waffo Pancake. AI PhotoPrompt does not receive or store your full payment-card number. Applicable taxes may be collected as required.

6. AI generation and third-party models

AI PhotoPrompt sends generation requests to third-party AI infrastructure, currently including fal.ai and model providers made available through that infrastructure. These may include models from OpenAI, Google, ByteDance/Seedream, Black Forest Labs and others shown in the product.

AI output is probabilistic. We do not guarantee a particular visual result, exact factual accuracy, model availability or uninterrupted service.

7. Failed generations and refunds

AI PhotoPrompt reserves credits before submitting a paid generation. If an eligible generation fails without a usable result, reserved credits are released back to your account.

• Unused paid credits: you may request a refund within 7 days of purchase if none of the credits from that purchase have been consumed.
• Consumed credits are generally non-refundable once the corresponding digital AI service has been delivered.
• Duplicate charges caused by a billing error are eligible for correction/refund.
• Confirmed service failures are handled through credit restoration first; additional refunds are evaluated where required by law.
• Nothing in this policy limits non-waivable consumer rights that apply in your jurisdiction.

8. Billing disputes

If you believe a charge is incorrect, please contact support@aiphotoprompt.io before initiating a payment dispute so we can investigate the order and credit ledger.

9. Your content and intellectual property

You retain rights you already have in prompts, reference images and other content you submit. You grant AI PhotoPrompt a limited license to process that content only as needed to provide, secure and troubleshoot the requested service. To the extent permitted by applicable law and third-party model terms, you may use generated outputs for lawful purposes.

AI PhotoPrompt does not intentionally use private generation inputs or outputs to train its own AI model without your explicit permission. Third-party providers process data under their own terms and privacy practices.

10. Acceptable use

• Do not generate or distribute unlawful, fraudulent, harassing or exploitative content.
• Do not create sexual content involving minors or otherwise violate child-safety laws.
• Do not use the service to impersonate real people deceptively, facilitate fraud or violate privacy/publicity rights.
• Do not upload content you do not have the right to use.
• Do not attack, scrape at abusive scale, reverse engineer security controls or bypass rate/credit limits.

11. Privacy and payment security

Your use of AI PhotoPrompt is also governed by the Privacy Policy. Payment-card information is handled by Waffo Pancake and does not need to be stored on AI PhotoPrompt servers.

12. Disclaimers and limitation of liability

The service is provided on an “as available” basis. AI outputs may be inaccurate, incomplete or unsuitable. Do not rely on generated content as legal, medical, financial or other professional advice.

To the maximum extent permitted by applicable law, AI PhotoPrompt is not liable for indirect, incidental or consequential loss arising from use of the service. Any mandatory liability remains unaffected.

13. Suspension, termination and account deletion

We may restrict or suspend accounts for material violations, fraud, payment abuse or legal requirements. You may request account deletion through the account/support channel. After deletion, account data is handled according to the Privacy Policy.

If AI PhotoPrompt permanently discontinues the paid service for reasons unrelated to your breach, we will provide an appropriate remedy for eligible unused paid credits where required.

14. Changes to these Terms

We may update these Terms as the product, law or payment/AI providers change. Material changes will be communicated by email or an in-product notice where reasonably practicable.

15. Governing law and disputes

These Terms are governed by the law applicable to the AI PhotoPrompt operator, subject to any mandatory consumer protections that apply to you. Before formal proceedings, please contact support@aiphotoprompt.io and allow us a reasonable opportunity to resolve the matter.
